Strategy relied on rarely invoked “famous foreign marks” doctrine. One of Massachusetts Lawyers Weekly’s “biggest defense wins” of the year.
• Successful resolution of claims for patent infringement and breach of employment obligations against three senior executives who left medical-device manufacturer to start separate business.
• Resolution after jury trial and appeal of Fortune 500 technology company in trademark dispute with Massachusetts software company.
• Jury verdict in favor of two patent lawyers in federal-court legal malpractice case arising from dispute over biotech patent, including effect of doctrines of prosecution-history estoppel and privilege to publicly assert patent rights.
• Preliminary and permanent injunction against website personally attacking lawyer, based on invasion-of-privacy theory, despite claim that lawyer was also a public official.
• Successful settlement, on behalf of lawyer and law firm, of legal malpractice claim arising from $52 million commercial arbitration award in trademark-licensing dispute.
