Domestic Relations & Probate Litigation |
Our domestic relations and probate/fiduciary litigators provide sophisticated counsel to clients across the full spectrum of matrimonial and probate/fiduciary disputes. We are experienced advocates and counselors in cases involving complex asset division, child custody, parenting plans (visitation), removal and relocation, child support, alimony, modification, and contempt issues arising in divorce, post-divorce, and paternity (children born outside of a marriage) cases. We also represent clients in the negotiation of premarital and postnuptial agreements, and in the enforcement of foreign judgments. Our attorneys also frequently serve as mediators, arbitrators, guardians ad litem, discovery and special masters, and in other neutral capacities. In addition to domestic relations, we frequently represent clients as trial attorneys in complex probate/fiduciary litigation, particularly will contests, disputes involving the interpretation or administration of trusts, and guardianship and conservatorship matters. We understand that the testimony and credibility of expert witnesses can be crucial in divorce and probate/fiduciary litigation, and we have extensive experience in preparing and effectively cross-examining experts involved in matters ranging from custody disputes to the valuation of closely held businesses, stocks, pension, profit-sharing and retirement plans, stock options, real estate, trusts and other assets. Our broad practice, strong reputation and extensive contacts in the business community enable us to assist our clients in finding other service providers, such as estate planning and accounting professionals, to help them deal with legal and other issues that arise in the context of family law and probate/fiduciary matters. Our attorneys have been recognized by The Best Lawyers in America and Massachusetts Super Lawyers in the area of family law. In addition, Tony Doniger has been recognized by Best Lawyers as “Boston Lawyer of the Year” in the area of family law. We are frequent lecturers on procedural and substantive issues in our practice areas and are active members of the American Academy of Matrimonial Lawyers, the Massachusetts Family and Probate American Inn of Court, the Greater Boston Family Law American Inn of Court, the Association of Family and Conciliation Courts, the Family Law Section of the Boston Bar Association, and the Boston Estate Planning Council. |
