Sugarman Rogers partner Lisa Goodheart has written a post for the blog of the American College of Environmental Lawyers (ACOEL), in which Lisa reveals the extraordinary background to a recent decision of the Massachusetts Supreme Judicial Court on energy policy, Engie Gas & LNG LLC v. Department of Public Utilities (August 2016). Lisa writes that while “environmental and energy lawyers readily recognized the decision as an important one,… it’s easy to see how future generations, far from the current action, might miss the excitement here.” She likens the underlying dispute to a duel of honor between, on the one hand, the state’s public-utility department and electrical-distribution companies, and, on the other, the Massachusetts attorney general and a coalition of environmentalists. “I can’t think of another moment,” Lisa writes, “when our courts were faced with environmental and energy-law disputes more laden with tension and drama….
