Sugarman Rogers partner Tony Agudelo obtained summary judgment in a products liability asbestos case that had been brought against an American distributor of foreign motor vehicles. The plaintiff had claimed that her husband had contracted mesothelioma and died as a result of his work on certain automobiles and automotive replacement parts. The plaintiff alleged that our client was negligent and failed to warn of the hazards of working with the defendant’s products. Her settlement demand was $2.2 million, but Tony won a dismissal of the case against its client after convincingly arguing that its client was neither negligent, nor had improperly failed to warn, nor had caused the plaintiff’s husband’s illness. |
