Sugarman Rogers partners John O’Neill and Jessica Park recently filed an amicus brief on behalf of the Massachusetts Insurance and Reinsurance Bar Association (MIReBA) in the leading Massachusetts COVID-19 insurance coverage case, Verveine Corp. v. Strathmore Ins. Co., which is pending before the Supreme Judicial Court.

Verveine involves a determination of whether losses suffered by several insured restaurants as a result of shutdown orders issued in the early days of the COVID-19 pandemic are covered under the business interruption or civil authority provisions of the restaurants’ property insurance policies. Massachusetts will be the first state supreme court to hear oral argument on this hotly-contested issue, which is the subject of thousands of lawsuits across the country.

MIReBA submitted the amicus brief to address certain issues of Massachusetts insurance law, which governs the policies at issue.
