Sugarman Rogers partner, Tony Agudelo, won the dismissals of two significant power tool product liability cases. In the first, Guzman v. Robert Bosch Tool Corporation, Tony successfully argued to the United States District Court for the Eastern District of New York that the plaintiff, who alleged injury while using a hand-held grinder, could not prove that the tool was defective. Not only did the court dismiss the case, it awarded Tony’s client reimbursement of certain costs incurred in defending the case. In the second case, McKeague v. One World Technologies, Inc., Tony earned the dismissal of a case where the plaintiff alleged injury while using a table saw. After the United States District Court for the District of Massachusetts dismissed the case against the plaintiff, the plaintiff appealed the decision to the First Circuit Court of Appeals. There, Tony prevailed again for his client, as the First Circuit affirmed the dismissal of the case and the judgment in favor of his client. |
