In the winter edition of the Massachusetts Bar Association’s Complex Commercial Litigation Quarterly newsletter, attorney Ken Thayer discusses a recent decision in Buffalo-Water 1 LLC v. Fidelity Real Estate Co., 481 Mass. 13 (2018) where the Supreme Judicial Court held that the mere appearance of an appraiser’s bias in favor of one party over the other will not invalidate the appraisal or be deemed a violation of the duty of good faith and fair dealing. |
