Sugarman Rogers’ Dylan Sanders represents plaintiffs in an important climate change case, Kain et al. v. Mass Department of Environmental Protection. The lawsuit, filed in Suffolk County Superior Court by four high school students (Sugarman Rogers’ clients), The Conservation Law Foundation and Mass Energy Consumers Alliance, argues that the DEP is failing to fulfill its legal obligations to reduce Massachusetts’ greenhouse gas emissions, as required by the 2008 Global Warming Solutions Act. On March 9th, Dylan argued in Suffolk County Superior Court, on behalf of the youth plaintiffs, that Massachusetts regulators must adopt strict limits on the annual emissions of greenhouse gases. The plaintiffs argue that if hard limits are not set for each year, the state is at risk of not meeting its goals for addressing climate change. According to the Global Warming Solutions Act, the DEP is required to set greenhouse gas emissions limits to help the state meet its goal of reducing those emissions by 25 percent by 2020 — and by 80 percent by 2050.
